Review Momentum Program™
Terms of Service
Last updated October 4, 20261. These terms
These terms govern access to and use of DaytonGrowthCo’s Review Momentum Program, including its client portal, onboarding, customer-system connections, email and text outreach, review-destination links, reporting, support, and billing features. They apply only to Review Momentum and not to unrelated DaytonGrowthCo products. Review Momentum is offered for business use. A person who signs an order, accepts an agreement, or authorizes payment confirms that they are authorized to act for the participating business.
2. What Review Momentum does
Review Momentum helps participating businesses send neutral review requests after approved customer events. A request may offer verified Google and Facebook destinations and a private way to contact the business. The program records delivery and link-selection activity, supports follow-up, and applies configured consent, timing, suppression, and duplicate-prevention controls.
3. Business responsibilities
A participating business must provide accurate information, maintain lawful access to connected systems, select only genuine customer events, and ensure it has all permissions and consents required for its messages. The business must keep its contact destination, review profiles, privacy policy, messaging terms, and customer records current. Passwords, one-time codes, and unrestricted credentials must not be submitted through ordinary portal forms or support tickets.
4. Honest review requests
Review Momentum must not be used to buy, incentivize, fabricate, suppress, or selectively solicit reviews based on expected sentiment. Requests must be sent only to genuine customers under consistent eligibility rules. Customers choose whether to respond and what to say. Google, Facebook, and other platforms control their own review experiences and may accept, reject, remove, or restrict content under their policies.
5. Messaging rules
Businesses must honor opt-outs and other reasonable requests to stop. Text recipients may reply STOP to opt out and HELP for help. Message frequency varies and message and data rates may apply. Email recipients may unsubscribe through the link in the message. Businesses may not upload purchased lists, scrape contact information, send unlawful or deceptive content, or use Review Momentum for unrelated bulk marketing.
6. Accounts and access
Account users are responsible for safeguarding their sign-in credentials and for actions taken through their accounts. Workspace owners control their team’s access. DaytonGrowthCo may suspend access when necessary to protect customers, providers, the platform, or other users, or when use appears unlawful, unsafe, or inconsistent with these terms.
7. Pricing, recurring charges, and payment
The signed agreement and its pricing schedule identify the exact program price, first term, renewal price, billing interval, minimum commitment, included services, usage formula, markup, and fixed fees. The same material billing terms are summarized again before payment. If a checkout summary conflicts with the signed agreement, DaytonGrowthCo will honor the signed agreement.
- Program charge. The first program fee is charged when Stripe confirms payment during onboarding, before outreach is activated. Renewal charges follow the monthly or annual schedule stated in the signed agreement.
- Usage charge. Email and SMS usage is calculated from provider records at the provider cost allocated to the workspace plus the service markup stated in the signed agreement, plus applicable tax. Prior-month usage is normally charged on the 15th of the following month. Delayed provider records, corrections, or credits may appear on a later invoice.
- Saved payment method. By signing the program agreement and completing Stripe checkout, the business authorizes DaytonGrowthCo to charge the saved payment method for the disclosed program fees, renewals, usage, and applicable taxes until that authorization ends under the agreement.
- Receipts and records. Stripe processes payment details and provides transaction records. DaytonGrowthCo may retain the signed agreement, consent record, checkout reference, invoices, usage records, service activity, support communications, and cancellation history as evidence of authorization and performance.
- Failed payment. A failed or overdue payment may pause outreach and access. The business remains responsible for valid accrued and committed amounts, plus reasonable collection costs where permitted by law.
8. Cancellation, refunds, and billing questions
A cancellation or non-renewal request may be sent to support@daytongrowth.co; no phone call is required. A request is effective when received, and DaytonGrowthCo will provide written confirmation. The deadline, remaining commitment, and effective end date are governed by the signed agreement. Cancellation prevents a future renewal when timely submitted, but does not retroactively cancel a valid charge, shorten an existing committed term, or eliminate accrued usage and tax.
Program fees and correctly calculated usage charges are non-refundable after payment except for a written exception or where applicable law requires otherwise. DaytonGrowthCo will correct a verified duplicate or incorrect charge. Nonuse, dissatisfaction, delay, suspension, or failure to obtain a desired number of reviews or other business result does not by itself create a refund or credit.
To help resolve a suspected billing error quickly, email support@daytongrowth.co with the business name, invoice date, and disputed amount, preferably within 30 days after the charge appears. Starting a bank or card dispute does not itself cancel the program or erase valid, undisputed obligations. Nothing in these terms waives any right that cannot lawfully be waived or permits DaytonGrowthCo to submit inaccurate evidence.
9. Third-party services
Review Momentum depends on third-party services such as customer-management systems, Stripe, Resend, Twilio, Google, Facebook, domain providers, and hosting services. Their availability, approval timelines, policies, and decisions are outside DaytonGrowthCo’s control. DaytonGrowthCo does not guarantee carrier registration, message delivery, publication of a review, search ranking, review volume, or a particular rating.
10. Client content and program materials
Businesses retain ownership of the names, logos, message customizations, customer information, and other materials they provide. They grant DaytonGrowthCo permission to use those materials only as needed to operate, support, secure, and improve Review Momentum. DaytonGrowthCo retains ownership of the platform, workflows, software, templates, documentation, and related program materials, excluding client content and third-party marks.
11. Confidentiality and data
Each party will use reasonable care to protect confidential information received through the program and will use it only for the relationship and permitted service operations. Our handling of personal information is described in the Review Momentum Privacy Policy.
12. Service changes and availability
We may update the program to improve reliability, security, compliance, or usability. Maintenance, provider outages, security events, or circumstances outside our control may interrupt service. We will use reasonable efforts to restore affected functionality and communicate material client-impacting issues.
13. Suspension and termination
Either party may end the program as allowed by the applicable order or agreement. DaytonGrowthCo may immediately pause outreach or access to address suspected unlawful messaging, missing consent, provider restrictions, security risk, nonpayment, or misuse. Provisions that by their nature should continue after termination remain in effect.
14. Disclaimers and responsibility
Review Momentum is provided subject to the applicable written agreement and available third-party services. To the extent permitted by law, DaytonGrowthCo is not responsible for indirect, incidental, special, exemplary, or consequential damages, lost profits, or business interruption arising from use of the program. Any additional warranties, liability limits, indemnities, governing law, or dispute terms in a signed order or services agreement control if they conflict with this page.
15. Resolving disputes
Before filing a legal claim, each party will give the other written notice describing the issue and requested resolution and will try in good faith to resolve it. The mediation, arbitration, governing-law, venue, claim-deadline, and other dispute terms in the signed program agreement apply. Payment-card disputes remain governed by applicable law and card-network rules.
16. Contact
Questions about these Review Momentum terms, billing, cancellation, or a suspected incorrect charge may be sent to support@daytongrowth.co.
